Terms of Use

By accessing or using PosturePro ("the Application"), you agree to be bound by these Terms of Use. These Terms constitute a legally binding agreement between you ("User" or "Practitioner") and Corporate Massage Therapies — Advanced Treatment Center LLC, operated by Luther Lockard, LMT ("we," "us," or "our").

If you do not agree to these Terms, you must not use the Application. Use of the Application by your organisation or on behalf of clients is also subject to these Terms.

PosturePro is a professional clinical software application designed for licensed and qualified movement practitioners, massage therapists, physiotherapists, chiropractors, posture coaches, and allied health professionals. The Application provides tools for:

• Gait and postural assessment documentation
• AI-assisted clinical summary generation
• AI-assisted treatment plan generation
• Exercise library management
• Client progress tracking and documentation
• Session and progress note recording

PosturePro is intended exclusively for use by qualified healthcare and movement professionals. By using the Application, you represent and warrant that:

• You are a licensed or certified practitioner in your field
• You will use the Application only within the scope of your professional qualifications
• You have obtained all necessary consents from your clients for collecting, processing, and storing their personal and health information
• You are at least 18 years of age

AI-generated content must be reviewed, interpreted, and validated by a qualified practitioner before being applied clinically. You are solely responsible for all clinical decisions made in connection with your clients. We expressly disclaim any liability for outcomes arising from reliance on AI-generated content without appropriate professional review.

You agree to:

• Maintain the confidentiality of your account credentials and not share access with unauthorised individuals
• Ensure that all client data entered into the Application is accurate and obtained with appropriate consent
• Comply with all applicable laws and regulations governing the collection, use, and storage of personal health information in your jurisdiction (including HIPAA where applicable)
• Use the Application only for lawful, professional clinical purposes
• Not attempt to reverse engineer, copy, or redistribute any part of the Application
• Not upload content that is unlawful, harmful, or violates the rights of any third party

You are responsible for obtaining informed consent from your clients before entering their personal and health information into PosturePro. You are the data controller for your clients' information. We act only as a data processor on your behalf.

Before emailing reports or summaries to clients through the Application, you are responsible for confirming that the client has consented to receive clinical information via email.

The PosturePro application, including its design, frameworks, AI prompting systems, exercise library structure, and all associated content created by us, is the intellectual property of Corporate Massage Therapies — Advanced Treatment Center LLC. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent.

Clinical data and content you create within the Application (client records, notes, treatment plans) remains yours. You retain ownership of your clinical data.

Access to PosturePro may require a paid subscription. Subscription terms, pricing, and billing are managed through the platform. By subscribing, you agree to pay all applicable fees as described at the time of purchase. Subscriptions renew automatically unless cancelled before the renewal date.

We reserve the right to modify pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new pricing.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Application, including but not limited to clinical outcomes, data loss, or business interruption.

Our total liability to you for any claim arising from use of the Application shall not exceed the amount you paid for the Application in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Corporate Massage Therapies — Advanced Treatment Center LLC, its officers, agents, and employees from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use of the Application, your violation of these Terms, or your violation of any law or the rights of a third party.

We reserve the right to suspend or terminate your access to PosturePro at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the platform, other users, or third parties.

You may close your account at any time. Upon termination, your access to client data will be subject to our data retention policy as described in the Privacy Policy.

We may update these Terms of Use from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Application after changes are posted constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the United States and the State in which Corporate Massage Therapies — Advanced Treatment Center LLC operates, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate courts of that jurisdiction.
